Medicaid planning for seniors is a delicate balance between helping clients preserve resources and ensuring they are fully protected from exploitation. This program provides attorneys, financial professionals, and elder law advisors with a clear framework for practicing ethically while navigating the complexities of Medicaid eligibility and asset protection.

Through a structured review of the ABA Model Rules of Professional Conduct, real-world case studies, and best practice checklists, participants will learn how to recognize red flags of undue influence, manage conflicts of interest, and safeguard seniors’ rights and dignity throughout the planning process. Special emphasis will be placed on client capacity, fee transparency, and protecting against common exploitation risks such as overcharging, unnecessary financial products, or family member pressure.

This session is designed to be practical and interactive, with scenarios and discussion prompts that prepare professionals to make sound ethical decisions in difficult situations. Attendees will leave with actionable tools, including a practical checklist for ethical Medicaid planning, and access to trusted resources such as the ABA Commission on Law and Aging, NAELA Ethics Guidelines, and state bar ethics opinions.
